AMB Advisory (Pty) Ltd respects the privacy of clients, prospective clients and website visitors. This notice explains how we collect, use, store and protect personal information in connection with our website and professional services.

This notice is provided with reference to the Protection of Personal Information Act 4 of 2013 (POPIA).

Information we may collect

Depending on the interaction, AMB Advisory may process:

  • Name and contact information.
  • Company and business information.
  • Correspondence and enquiry information.
  • Information supplied when requesting a formal quote.
  • Engagement and client-acceptance information.
  • Financial records and supporting documentation supplied during an Independent Review engagement.
  • Billing and payment-related business information where applicable.
  • Information required to comply with legal, professional or regulatory obligations.
  • Limited technical information required to operate and protect the website, such as IP address, browser/device information and infrastructure/security logs.

Independent Review assessment

The “Do I Need an Independent Review?” assessment runs in your browser. The answers entered into the assessment are not automatically submitted to or stored by AMB Advisory.

The assessment does not ask for your name, company name, email address or telephone number.

If you later contact AMB Advisory, information you choose to provide in that separate communication may be processed for that enquiry.

Indicative quote calculator

The indicative quote calculator runs in your browser. Your quote answers are not automatically transmitted to or stored by AMB Advisory.

If you choose to request a formal quote, the website prepares a summary containing the indicative fee range, the relevant quote answers and the contact details you enter.

The summary is shown to you before you choose to send it.

The website prepares an email on your device. The quote request is sent only if you choose to send that email using your email application.

The website itself does not automatically submit the quote request to AMB Advisory.

If you use the Copy function, the quote request is copied to your device’s clipboard.

Why we process personal information

We process personal information where needed for:

  • Responding to enquiries and preparing and discussing fee proposals.
  • Assessing potential engagements, including client-acceptance and independence procedures.
  • Entering into and administering engagements and performing Independent Review services.
  • Communicating with clients and maintaining engagement and professional records.
  • Billing and administration.
  • Complying with legal, regulatory and professional obligations.
  • Securing our website, systems and information and preventing misuse or security incidents.
  • Establishing, exercising or defending legal rights where necessary.

How we obtain personal information

Information may come directly from you, from the company or organisation you represent, or from directors, employees, accountants or advisers involved in an engagement.

We may also obtain information from documents and records supplied during an engagement, public sources where relevant and lawful, and website, email and technology infrastructure that generates technical or security information.

When information may be shared

AMB Advisory does not sell personal information.

Where reasonably necessary, information may be shared with:

  • Technology and cloud-service providers.
  • Email and productivity-service providers.
  • Professional advisers.
  • Service providers required to support an engagement.
  • Regulators, professional bodies, courts or authorities where required or permitted by law.

Service providers should receive information only to the extent reasonably necessary for their role and subject to appropriate confidentiality and data-protection arrangements where applicable.

Microsoft 365

AMB Advisory uses Microsoft 365 services for business email, communication and document management.

Personal information supplied through email, correspondence or client documents may therefore be processed using Microsoft cloud services.

Website infrastructure

The website may be delivered using hosting, content-delivery, security and domain-name infrastructure providers. Those providers may process limited technical information necessary to deliver, operate and secure the website.

Processing outside South Africa

Some technology and cloud-service providers used by AMB Advisory may process or store information outside South Africa.

Where personal information is transferred across borders, AMB Advisory will take reasonable steps to ensure that the transfer and processing are permitted under applicable data-protection requirements and that appropriate safeguards are in place.

How long information is kept

Personal information is retained only for as long as reasonably necessary for the purpose for which it was collected, or for longer where retention is required or permitted by law, professional standards, contractual requirements or legitimate business needs.

When information is no longer authorised or required to be retained, AMB Advisory will take reasonable steps to delete, destroy or de-identify it as appropriate.

How information is protected

AMB Advisory uses reasonable technical and organisational safeguards designed to protect personal information against loss, unauthorised access, interference, misuse, alteration or disclosure.

These may include access controls, appropriate user permissions, secure business systems, confidentiality controls and reasonable protections for client documents.

Cookies and tracking

The current AMB Advisory website does not use advertising cookies, marketing trackers or behavioural analytics.

The Independent Review assessment and indicative quote calculator do not use cookies or browser storage to retain the answers entered.

If the website’s use of cookies, analytics or similar technologies changes in future, this notice will be updated and any required notices or choices will be provided.

Direct marketing

Submitting an enquiry or requesting a quote does not automatically subscribe you to marketing communications.

Your rights

Subject to applicable law, you may request:

  • Confirmation of whether AMB Advisory holds personal information about you.
  • Access to your personal information.
  • Correction or updating of inaccurate information.
  • Deletion or destruction where applicable.
  • Objection to certain processing where permitted.
  • Information about how your personal information is processed.
